Labour Market Testing – Gumtree

Some visas require the employer to provide evidence that the position cannot be filled from within the local labour market, prior to formalising an employment contract and submitting a visa application.

Labour market testing generally involves two forms of advertising evidence over a 28 day period within the 4 months months immediately prior to application.

The advertisement must include:

  • the title, or a description, of the position. Note, multiple positions in one advertisement are acceptable
  • the skills or experience required for the position
  • the name of the approved sponsor or the name of the recruitment agency being used by the sponsor and
  • the salary for the position – if the annual earnings for the position are lower than AUD96,400. Note: it is acceptable to publish a salary range—for example AUD80,000 to AUD90,000

The Department of Home Affairs has now confirmed that advertising on Gumtree is considered acceptable for labour market testing purposes, as long as the vacancy is listed in its jobs section.

Other recruitment websites that are acceptable for labour market testing purposes include:

  • SEEK
  • Indeed
  • Adzuna
  • JobActive
  • LinkedIn (Recruitment plateform)
